To the Honorable Senate and House of Representatives:

 

Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Validating The Action Taken at the Town Election Held By the Town of Lanesborough.” 

 

Senator Downing, Representative Guyer and the Lanesborough Board of Selectmen have asked that this legislation be filed to validate the results of the May 15, 2007, annual town election in the Town of Lanesborough.  Absent this legislation, the Town and the Town’s elected officials face the risk of legal challenges to their power and governance.  And holding a special election would cost the Town significantly.

 

Accordingly, I urge your early and favorable consideration of this bill.

In the Year Two Thousand and Seven.

an act validating the action taken at the annual town election held in the town of Lanesborough.

 

        Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

 


SECTION 1. Notwithstanding the provisions of sections 9 and 10 of chapter 39 of the general laws, or of any other general or special law or bylaw to the contrary, the votes taken by the town of Lanesborough at its May 15, 2007, annual town election, and all actions taken pursuant thereto, are hereby ratified, validated and confirmed, notwithstanding any defect or omission with regard to the warrant for the election.

 

SECTION 2. This act shall take effect upon its passage.
