Be it enacted by the Senate and House
of Representatives in General Court assembled, and by the authority of the
same, as follows:
SECTION 1. Chapter 94 of the General Laws, as appearing in the 2006 Official Edition, is hereby amended by inserting after section 271 thereof the following new section:
Section 271A. Notwithstanding any General or special law, or any rule or regulation to the contrary, any mattress, box spring, studio couch or futon mattress sold in the Commonwealth which has been delivered to, and used by a customer in anyway for any period of time, and which said mattress, box spring, studio couch or futon mattress has been returned to the seller thereof by such customer shall be clearly and conspicuously marked thereon and advertised by such seller prior to any further sale of said mattress, box spring, studio couch or futon mattress with a price tag stating the following: “ This mattress, box spring, studio couch or futon mattress has been previously sold, delivered, used and returned, and is being offered for resale.”
