An Act RELATIVE TO ILLEGAL PARKING IN BUS STOPS

 

                Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

 

SECTION 1.   Section 20A of chapter 90 of the General Laws, as appearing in the 2006 Official Edition, is hereby amended by adding the following:-       

     Notwithstanding the foregoing or any other general or special law to the contrary, the fine for the violation of parking of a motor vehicle within a posted bus stop shall be $100.

 

SECTION 2.  Section 20A ˝ of said chapter 90, as so appearing, is hereby amended by adding the following:-

     Notwithstanding the foregoing or any other general or special law to the contrary, the fine for the violation of parking of a motor vehicle within a posted bus stop shall be $100.

 

SECTION 3.        Chapter 161A of the General Laws, as appearing in the 2006 Official Edition, is hereby amended by striking out section 46 in its entirety and inserting in place thereof the following new section:-

     Section 46.  The directors may promulgate rules and regulations pertaining to the parking of motor vehicles in any terminals, stations, garages, yards, shops, parking lots, or parking garages owned or operated by the authority.  The authority shall not promulgate rules and regulations concerning any streets, ways, highways, roads and parkways.  The authority may, by a vote of the directors, adopt the provisions of section 20A of chapter 90; provided, however, that the directors establish rules and regulations creating regional districts throughout the authority consisting of contiguous cities or towns within which the parking clerk shall regularly conduct hearings.  Notwithstanding any general or special law to the contrary, the authority is hereby authorized to promulgate rules and regulations concerning any posted authority bus stops throughout the entire service area; provided, that the authority, in consultation with the registry of motor vehicles, shall develop a uniform citation for the violation of parking within a posted authority bus stop; provided, further, that all citations for parking in a posted authority bus stop issued by the authority shall be processed by the authority and the revenue generated from said citations shall be distributed fifty per cent to the authority and fifty per cent to the municipality in which the citation was issued.  Notwithstanding the foregoing or general or special law to the contrary, nothing provided herein shall diminish or derogate the ability of any municipality to issue citations for parking in a posted bus stop within said municipality; provided, further, that all citations for parking in a posted bus stop issued by a municipality shall be processed by said municipality and said municipality shall retain any and all revenue generated by said citations; provided, further, that, notwithstanding the foregoing and any general or special law to the contrary, in the event that a municipality and the authority have entered into an agreement concerning the issuance of citations for parking in a posted bus stop prior to the enactment of this provision, the terms of said agreement shall govern the issuance of citations for parking in a posted bus stop by the authority within said municipality, unless and until the termination of said agreement.
