An Act authorizing the City of Revere Retirement Board to pay an alternative retirement allowance to the surviving spouse of a decease fire captain of said city |
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Ordered: That a petition to the General Court accompanied by a bill for a special law relating to the City of Revere to be filed with an attested copy of this order be, and hereby is approved under clause (1) of Section 8 of Article 2, as amended of the Amendments to the Constitution of the Commonwealth of Massachusetts, to the end that legislation be adopted precisely as follows, except for clerical or editorial changes of form only:
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
An Act Authorizing The City of Revere Retirement Board To Pay An Alternative Retirement Allowance To The Surviving Spouse of A Decease Fire Captain of Said City.
Section 1. Notwithstanding the provisions of Section 7, 9, 12 and 101 of Chapter 32 of the General Laws or any other general or special law to the contrary in order to promote the public good, the retirement board of the City of Revere is hereby authorized to pay an alternative retirement allowance in lieu of any other survivor benefits payable pursuant to Chapter 32 of the General Laws, to Kathryn Walsh, the surviving spouse of John P. Walsh, late retired fire captain of the fire department of the City of Revere. Said alternative retirement allowance shall be calculated by the said retirement board, based upon the survivor allowance, as provided for by the first sentence of Chapter 32, Section 12 (ii), Option (c) of the General Laws, had Captain Walsh been allowed to select Option (c) on the date of his retirement from the fire department of the City of Revere and had he nominated his surviving spouse as his Option (c) beneficiary.
Any benefits payable to Kathryn Walsh, pursuant to he provisions of this act shall be reduced by the amount of any survivor pension benefits previously paid to her as the survivor spouse, pursuant to the provisions of Section 101 and Section 11 (2) of the general laws. Said Kathryn Walsh shall be entitled to receive any cost of living adjustments granted in accordance with the provisions of Sections 102 and 103 of Chapter 32 of the General Laws. The provisions of this section shall be deemed to have been in effect as of July 30, 2007.
Section 2. Notwithstanding the provisions of any general or special law to he contrary any proposed home rule petition to be submitted to the Massachusetts Legislature by the Mayor and City Council of the City of Revere, following the effective date of this act which proposes to modify or amend the provisions of Chapter 32 of the General Laws for the benefit of an individual employee of the City of Revere or for the benefit of the employee’s survivor, shall first be submitted to the retirement board of the City of Revere for the board’s fiduciary review and approval. If the retirement board approves the submission of the aforementioned home rule petition, by a unanimous vote of all the members of the retirement board, the proposed home rule petition shall thereafter be submitted to the Mayor and City Council for their consideration and approval prior to submission to the Massachusetts Legislature. If the retirement board fails to approve the home rule petition referred to herein the proposed home rule petition shall not be submitted to the Mayor and City Council.
Section 3. This act shall take effect upon its passage.
And Be It Further Resolved that the City Council of the City of Revere requests the Representative from this District to file the attached legislative petition.
