An Act providing for the merger of the Turners Falls Fire District and the Lake Pleasant Water Supply District |
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. The inhabitants of the town of Montague liable to taxation residing within the territory of said town now included in the Lake Pleasant Water Supply district as described in section 1 of chapter 449 of the acts of 1908 shall constitute a water district and are hereby made a body corporate by the name of Turners Falls Fire District shall constitute a water district, hereinafter called the district, for the purpose of supplying themselves with water for the extinguishment of fires and for domestic and other purposes, with power to establish fountains and hydrants and to relocate and discontinue the same, to regulate the use of water and to fix and collect rates to be paid therefore, and for the purposes of assessing and raising taxes as provided herein for the payment of the services, and for defraying the necessary expenses of carrying on the business of the district, subject to all general laws now or hereafter in force relating to water districts, except as otherwise provided herein. The district shall have power to prosecute and defend all actions.
SECTION 2. The Lake Peasant Water Supply District, established under chapter 499 of the acts of 1908, is hereby dissolved and, without any further conveyance or other action, all the assets, liabilities, obligations and indebtedness as well as the powers and dates of the Lake Pleasant Water Supply District are hereby merged and transferred to the Turners Falls Fire District. The board of water commissioners of the Lake Pleasant Water Supply District is hereby abolished and the tenure of the incumbent members of the board shall terminate on the effective date of the act.
SECTION 3. Notwithstanding any other provision of this act, no fire protection service shall be offered or provided to the Lake Pleasant Water Supply District by the Turners Falls Fire District.
