Highways and town ways shall be kept in repair at the expense of the town in which they are situated, so that they may be reasonably safe and convenient for travelers at all seasons.  Railroad crossings at grade with such highways and town ways shall be kept in a reasonable state of repair at the expense of the owner of said railroad crossing; provided, however, that this provision shall not apply to railroad crossings owned by the Massachusetts Bay Transportation Authority.
