An Act designating architect emeritus status.

 

                Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

 

SECTION 1.   Section 60A of chapter 112 of the General Laws, as appearing in the 2006 Official Edition, is hereby amended by inserting, after the definition of “Architect”, the following definition:-

“Architect emeritus”, an honorary title issued to an architect who has retired from the active practice of architecture and who does not engage or offer to engage in the practice of architecture.

 

SECTION 2. Section 60D of said chapter 112 of the General Laws, as so appearing, is hereby amended by inserting after the word “architect”, in line 2, the following words:- or architect emeritus

 

SECTION 3. Said chapter 112 of the General Laws, as so appearing, is hereby further amended by striking out sections 60N through 60O, inclusive, and inserting in place thereof the following 3 sections:-

Section 60N. (a) Upon receipt of a written application the board may grant a certificate of registration as an architect emeritus to a retired architect. To be eligible for a certificate of registration as an architect emeritus the applicant shall, without limitation: (i) submit an application together with a fee prescribed by the board prior to the expiration of the architect’s certificate of registration; (ii) be an architect in good standing at the time of application; (iii) be at least 65 years of age; (iv) have been a registered architect for a period of at least 10 years; and (v) relinquish his license to practice architecture.

 

(b) An architect emeritus shall not engage in, nor hold himself out as engaging in, the practice of architecture and shall be exempt from the continuing education requirements established pursuant to this chapter.

(c) An architect emeritus seeking reinstatement as an architect shall, without limitation: (i) file a written request with the board; (ii) file a reinstatement application and pay an administrative fee determined by the board; and (iii) comply with education or other requirement established by the board.

Section 60O. The board shall be charged with the enforcement of the provisions of sections 60A to 60N, inclusive. If any person refuses to obey any decision of the board, the attorney general shall, upon request of the board, file a petition for the enforcement of such decision in equity in the superior court for Suffolk county or for the county in which the defendant resides or has a place of business. After due hearing, the court shall order the enforcement of such decision or any part thereof, if legally and properly made by the board.

Section 60P. Whoever violates any provisions of sections 60A to 60N, inclusive, shall be punished by a fine of not more than $500.00 or by imprisonment in a jail or house of correction for not more than 3 months, or both.
