To the Honorable Senate and House of Representatives:
Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Validating The Actions Taken At A Certain Special Town Election Held In The Town Of Oak Bluffs.”
Senator O’Leary, Representative Turkington, the Oak Bluffs Board of Selectmen and Oak Bluffs Town Administrator have asked that this legislation be filed to validate the actions taken at the special town election on May 28, 2008. Absent this legislation, the town would have to hold a special town election, which would strain the town’s budget, and further delay the town from finalizing its fiscal year 2009 budget.
To ensure the town of Oak Bluffs may finalize its fiscal year 2008 budget promptly, I urge your early and favorable consideration of this bill.

In the Year Two Thousand and Eight.

An Act validating the action taken at the special town election held in the town of Oak Bluffs.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding the provisions of sections 9, 9A and 10 of chapter 39 of the General Laws, or of any other general or special law or bylaw to the contrary, the votes taken by the town of Oak Bluffs at its May 28, 2008, special town election, and all actions taken pursuant thereto, are hereby ratified, validated and confirmed, notwithstanding any defect or omission with regard to the warrant for the election.
SECTION 2. This act shall take effect upon its passage.
