AN ACT to create a lottery to benefit the natural resources of the commonwealth

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Section 24 of Chapter 10 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by inserting the following language after the last sentence:

The commission is authorized and directed to create a specific lottery ticket or tickets for the benefit of the natural resources of the commonwealth and shall determine the types of lottery or lotteries to be conducted, the price or prices of tickets in the lottery, the number and sizes of the prizes on the winning tickets or shares, the manner of selecting the winning tickets or shares, the manner of payment of prizes to the holders of winner tickets or shares, the frequency of drawings or selections of winning tickets or shares, and the type or types of locations at which tickets or shares may be sold, and all other matters authorized by law.

The commission shall make an annual report in the month of October and a semi-annual report in the month of April to the governor, the attorney general, and the general court, the total revenues of lottery or lotteries conducted for the wildlife, prize disbursements, and other expenses for the preceding period, which shall include a full and complete statement of such environmental lottery revenues, prize disbursement, and other expenses, including such recommendations as it may deem necessary or advisable.

Revenues from said ticket or tickets shall be distributed, following the payment of prizes and administrative costs, to department of fisheries, wildlife and environmental law enforcement within the executive office of environmental affairs not less than two times per year.

Revenue distribution:

Inland Fisheries and Game Fund.............20% for publication of informational literature

Public Access Fund.............50% for the acquisition and maintenance of access points on rivers, lakes, ponds and streams, and construction and maintenance of fishways

Environmental Law Enforcement Fund.................... 10%

Marine Fisheries Fund............................... 10%

Natural Heritage and Endangered Species..............10%
