AN ACT relative to the reporting of criminal convictions of certain professionals

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Chapter 221 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by striking out section 26, and inserting in place thereof the following new section: -

            Section 26.  If any physician, or other individual who is required to be licensed or registered under any provisions of chapter one hundred twelve, one hundred forty-one or one hundred forty-two, is convicted of any crime, the clerk of the court shall within one week thereafter report the same to the appropriate board of registration, together with a certified copy of the court proceedings in the case.

            In any instance where a physician or other individual who is required to be licensed or registered pursuant to any provisions of chapters one hundred twelve, one hundred forty-one or one hundred forty-two pleads nolo contendere to criminal charges, or admits to sufficient facts to permit a court of competent jurisdiction to find him guilty of a crime but the matter is continued without a finding by the court, the clerk of such court shall within one week thereafter report the same to the appropriate board of registration, together with a certified copy of the court proceedings in the case.

If any individual is convicted of practicing without a license or registration in a profession for which licensure or registration is required under any of the provisions of chapters one hundred twelve, one hundred forty-one or one hundred forty-two, or is convicted of holding himself out as a practitioner of such a profession, the clerk of the court shall within one week thereafter report the same to the appropriate board of registration, together with a certified copy of the court proceedings in the case.
