AN ACT relative to the continuation of educational services

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1:  Section 37H of Chapter 71, as appearing in the 2004 Official Edition, is hereby amended  by striking out subsection (e) and inserting in place thereof the following paragraph:-

When a student is expelled under the provisions of this section,   the school district must continue to provide educational services to said student. Educational services may include but need not be limited to psychological and/or educational evaluations or a special education initial evaluation (parent consent required), community service, alternative educational setting, or any other educational programming that allows the student to continue his/her education…

SECTION 2:  Section 37H ˝ of Chapter 71, as appearing in the 2004 Official Edition, is hereby amended by striking out, in lines 55 and 56, the words “no school or school district shall be required to provide educational services to such student”, and inserting in place thereof the following:-

“the school or school district shall be required to provide alternative educational services to the student.”
