AN ACT relating to private occupational schools

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section four of chapter 75C of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by striking out lines 42 through 47 and inserting in place thereof the following sentence:

Each such indemnification shall be conditioned to provide that the obligor shall satisfy all valid claims, as determined by the commissioner, to recover damages sustained by students resulting from a breach of contract; provided, however that the aggregate liability of the person providing indemnification for all breaches of the conditions of the indemnification shall in no event, exceed the sum of such indemnification.

SECTION 2.  Section fourteen of chapter 75D of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by striking out lines 47 through 52 and inserting in place thereof the following sentence:

Each such indemnification shall be conditioned to provide that the obligor shall satisfy all valid claims, as determined by the commissioner, to recover damages sustained by students resulting from a breach of contract; provided, however that the aggregate liability of the person providing indemnification for all breaches of the conditions of the indemnification shall in no event, exceed the sum of such indemnification.

SECTION 3.  Section twenty-one F of chapter 93 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by striking out lines 42 through 47 and inserting in place thereof the following sentence:

Each such indemnification shall be conditioned to provide that the obligor shall satisfy all valid claims, as determined by the commissioner, to recover damages sustained by students resulting from a breach of contract; provided, however that the aggregate liability of the person providing indemnification for all breaches of the conditions of the indemnification shall in no event, exceed the sum of such indemnification.
