Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 29 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by inserting after Section 2FF the following 2 sections:-
Section 2FFF. There shall be established and set up on the books of the commonwealth a separate fund to be known as the Integrated Pest Management Fund. Monies generated from the following sources shall be deposited in the Integrated Pest Management Fund:
(a) revenues generated pursuant to chapter sixty-four H from the sales of products listed in section six, sub-section (p), item (3) and not otherwise exempted from such taxation pursuant to said section.
(b) Fifty percent of revenues collected from fees and penalties pursuant to chapter twenty-one I, sections nineteen and twenty-one.
The books and records of the Integrated Pest Management Fund shall be subject to an annual audit by the state auditor. The department of food and agriculture may expend such funds, subject to appropriation, for the purposes of fostering integrated pest management programs, including, but not limited to: education, outreach, research, labeling, and creating and providing incentives to use integrated pest management. Said department shall make at least fifty percent of the funds appropriated from the fund available for the purposes herein described for the University of Massachusetts, provided that the university shall not assess any overhead costs or charges to monies allocated thereto from the fund. No expenditure from said fund shall cause said fund to be in deficiency at the close of a fiscal year.
The commissioner of the department of food and agriculture shall submit a report annually to the clerk of the house and clerk of the senate, describing income into the fund, and expenditures from the fund and their purposes.
SECTION 2FFFF. Chapter 64H of the General Laws is hereby amended in section six, subsection (p), item (3) by inserting after the words “same use” the words “, when purchased by a person licensed pursuant to chapter one hundred thirty-two B;”
