AN ACT REGULATING BRUSH BURNING SEASON

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding any general or special law to the contrary, the department of environmental protection shall adopt regulations restricting open burning of combustible materials including, but not limited to, restricting the disposal of brush, cane, driftwood and forestry debris, excluding grass, hay, leaves and stumps.  Such regulations shall allow for burning of brush, cane, driftwood and forestry debris, excluding grass, hay, leaves and stumps, during the periods from March 1 to April 30 and from October 1 to November 30 of each year, in such municipalities and under such conditions as the department deems reasonable and safe.
