AN ACT relating to the distribution and sale of household cleaning products containing phosphorous

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 5R of Chapter 111 of the General Laws is hereby amended by striking Paragraph 7 and inserting in the place thereof the following new paragraph-

No household cleansing product which contains a phosphorous compound in concentrations in excess of a trace quantity, except those used in commercial dishwashing machines, commercial laundries, for cleansing medical and surgical equipment, food and beverage processing equipment, and dairy equipment shall be distributed, sold, offered or exposed for sale at retail, wholesale, or used in a commercial establishment in the commonwealth after July 1st, 2010. All manufacturers of household cleansing products for household dishwashing machines shall be required to reduce the concentration of phosphorous in these detergents to a trace quantity by July 1st, 2010.

SECTION 2 Paragraph 8, of Section 5R of Chapter 111 in line 40 of the General Laws is hereby amended by inserting after the words “elemental phosphorous, used in”, the word “commercial”.
