AN ACT relative to long term care insurance

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 33 of Chapter 118E, as appearing in the 2004 Official Edition is hereby amended by inserting after the last the paragraph the following paragraph:-

Provided however that in order to be protected from such a claim under §31 or §32 the long term care insurance provided to the individual receiving medical assistance must provide home health care benefits of at least 50 per cent of the nursing home benefit or one hundred dollars per day whichever is greater and must provide an elimination period of no more than one hundred days or a deductible, in lieu of the elimination period, of no more than sixteen thousand seven hundred dollars.
