AN ACT ensuring continuity of behavioral health services

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.   Chapter 176O of the Massachusetts general laws as appearing in the 2002 official edition is amended by inserting the following new Section:

"Section 16: A carrier which contracts with a utilization review organization or other third party to administer its behavioral health benefits shall continue to maintain primary responsibility for ensuring that its insured receive all benefits mandated by law, regardless of the financial status of the utilization review organization or third party administrator. A carrier shall provide timely reimbursement for the legitimate claims of providers in the event a utilization review organization or third party administrator is unable to provide said reimbursements."
