Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law or rule or regulation to the contrary, the division of health care finance and policy shall include acute hospitals, community health centers, and community mental health programs and substance abuse programs licensed and regulated by the Department of Public Health pursuant to Title 105 of the Code of Massachusetts Regulations Chapters 140.000 Subparts E and H, 160.000, 161.000, and 162.000 among providers eligible for reimbursement from the uncompensated care pool trust fund for the provision of uncompensated care.
SECTION 2. Notwithstanding any general or special law or rule or regulation to the contrary, the Health Safety Net Office shall include acute hospitals, community health centers, and community mental health programs and substance abuse programs licensed and regulated by the Department of Public Health pursuant to Title 105 of the Code of Massachusetts Regulations Chapters 140.000 Subparts E and H, 160.000, 161.000, and 162.000 along with acute hospitals and community health among providers eligible for reimbursement from the health safety net trust fund for the provision of uncompensated care.
SECTION 3. Section 1 of this act is hereby repealed.
SECTION 4. Sections 2 and 3 shall take effect on October 1, 2007.
