AN ACT protecting assets of the spouse of a nursing home resident

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 21A of Chapter 118E of the General Laws, as appearing in the 2004 official edition, is hereby amended in subsection (2)(v) by adding at the end thereof the following:

provided that, the division shall establish the maximum community spouse resource allowance permissible under 42 U.S.C. s.1396r-5(f)(2);
