Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 6B of Chapter 118G of the general laws, as inserted by Section 42 of chapter 58 of the Acts of 2006, is hereby amended by inserting after the second sentence the following sentence: An applicant for uncompensated care pool assistance, and any successor safety net coverage, shall not be determined ineligible based solely on inability to provide citizenship documentation as required by the MassHealth Program pursuant to Section 6036 of U.S. Public Law 109-171.
SECTION 2: Clause (3) of subsection (a) of section 3 of chapter 118H of the general laws, as inserted by section 45 of chapter 58 of the acts of 2006, is hereby amended by inserting at the end thereof the following: ; provided, however, that the inability to provide citizenship documentation as required by the MassHealth Program pursuant to Section 6036 of U.S. Public Law 109-171 shall be evidence that the individual is not eligible for any MassHealth program.
