establishing a campus rape and sexual assault prevention
advisory council. Higher Education.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 9 of chapter 15A of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by adding the following paragraph: -
The board shall create a campus rape and sexual assault prevention advisory council. The campus rape and sexual assault prevention advisory council shall establish uniform guidelines and provide support for state institutions of higher education and campus organizations which assist rape and sexual assault victims, or that provide victim’s rights services to victims of rape and sexual assault, for any victim of rape or sexual assault that occurred on the campus of any public institution of higher education in the commonwealth where the victim or alleged perpetrator is a student at the institution, or where the victim is a student who was involved in an off-campus rape or sexual assault. Members of the council shall be appointed by the chairman of the board and shall include, but need not be limited to, 1 representative from each of the following: a campus based judicial affairs officer, a campus based sexual assault service provider, a community based sexual assault service provider, a campus administrator in charge of student/residential life, a campus police department, a state or municipal police department, a district attorney’s office, and a victim rights advocacy group. For the purposes of this paragraph, “rape or sexual assault” shall mean the commission of, solicitation of, or the conspiracy to commit any one incident of the following offenses:
(1) indecent assault and battery on a child under 14, under section 13B of chapter 265;
(2) indecent assault and battery on a person who has attained the age of 14, under section 13H of chapter 265;
(3) rape, under section 22 of chapter 265;
(4) rape of a child under 16 by force, under section 22A of chapter 265;
(5) rape and abuse of a child under 16, under section 23 of chapter 265;
(6) assault with intent to commit rape, under section 24 of chapter 265;
(7) assault of a child under 16 with intent to rape, under section 24B of chapter 265;
(8) open and gross lewdness and lascivious behavior, under section 16 of chapter 272;
(9) unnatural and lascivious acts with a child under 16, under section 35A of chapter 272;
(10) stalking, under section 43 of chapter 265; or
(11) criminal harassment, under section 43A of chapter 265.
