AN ACT increasing the penalty for motor vehicle homicide

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Section 24G of chapter 90 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by striking out, in lines 14 to 17, inclusive, the words “and a fine of not more than five thousand dollars, or by imprisonment in a jail or house of correction for not less than one year nor more than two and one-half years and a fine of not more than five thousand dollars.” and by inserting in place thereof the following words:-  and a fine of not more than $10,000, or by imprisonment in a jail or house of correction for not less than 1 year nor more than 2 ½  years and a fine of not more than $10,000.

SECTION 2.  Said section 24G of said chapter 90, as so appearing, is hereby further amended by striking out, in lines 45 to 48, inclusive, the words “shall be punished by imprisonment in a jail or house of correction for not less than thirty days nor more than two and one-half years, or by a fine of not less than three hundred nor more than three thousand dollars, or both.” and by inserting in place thereof the following words:-  shall be punished by imprisonment in the house of correction for not less than 60 days nor more than 2 ½ years, or by not more than 5 years in state prison, or by a fine of not less than $600 nor more than $6,000, or by both such fine and imprisonment.
