AN ACT relative to cost of living adjustments for retired judges

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Chapter 32 of Massachusetts General Law is hereby amended by adding the following new Section;

65L.  All Justices of the Supreme Judicial Court, Appeals Court and the several departments of the Trial Court who have reached the mandatory retirement age of 70 by January 1, 2007 and after said date,  under the Massachusetts Constitution, Part II, c. 3, art. 1, as amended by art 98 of the Amendments, shall be entitled to an adjustment to their annual pension in an amount equal to, but not more than, the Consumer Price Index as reported in the Wall Street Journal on June 1 prior to the commencement of the next fiscal year.  This provision shall become effective in fiscal year 2008, shall apply to all retired justices and shall be retroactive to Fiscal Year 2003.
