legislation relative to discrimination against motorcycle
operators. The Judiciary. |
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, it shall be unlawful for a facility open to the public to refuse service to a person based on that person’s means of transportation by motorcycle, the wearing of a helmet, motorcycle insignia or jacket, or having a tattoo.
SECTION 2. Notwithstanding any general or special law to the contrary, it shall be unlawful for a public or private employer to refuse employment to a person based on that person’s use of a motorcycle, wearing of a helmet, motorcycle insignia or jacket or having a tattoo.
SECTION3. Notwithstanding any general or special law to the contrary, it shall be unlawful for a landlord to refuse to rent to a person based on that person’s use of a motorcycle, wearing of a helmet, motorcycle insignia or jacket or having a tattoo.
SECTION 4. A person aggrieved by a violation of section 1, 2 or 3 shall have a cause of action in a district or superior court for damages, including punitive damages, attorney fees and court costs.
