AN ACT relative to judicial review of site plan approval

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The General Laws as appearing in the 2004 Official Edition are herby amended by inserting after line 76 in section 17 of chapter 40A the following new paragraph:-

Any site plan approval required by a zoning bylaw or ordinance shall be appealed in the same manner as a special permit within twenty days of the applicant’s receipt of notice of the approval and no other means of appeal shall be permitted. Only an applicant aggrieved by the decision shall have standing to appeal the site plan approval.
