AN ACT extending the statute of limitations for certain wrongful death actions

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.

Whereas, the deferred operation of this act would tend to defeat its purpose, which is to forthwith extend the statute of limitations for certain wrongful death actions, it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

Chapter 260 of the General Laws is herby amended by inserting after section 4C the following section:-

            Section 4D.  Actions for wrongful death, which death was the result of a willful, wanton or reckless act or omission may be commenced at any time after the death of the decedent. 

            SECTION 2.  Section 1 shall apply to any action arising on or after the effective date of this act and to any action arising before the effective date of this act.
