In the Year Two Thousand and Seven.

AN ACT prohibiting sex between teachers and students

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Chapter 272 of the general laws is hereby amended by inserting after section 35A the following section:-

“Section 35B.  Any employee of a public or private high school who has sexual intercourse, regardless of consent, with a person who is under the age of 18 and who is not the employee’s spouse shall be punished by imprisonment in the house of correction for not more than 2 ½ years or by a fine of not more than $10,000 or both if at the time the sexual intercourse took place that person is a student within the employee’s school and the employee is more than 4 years older than that person.”
