AN ACT provide daily access to fresh air for clients of the Department of Mental Health

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 23 of Chapter 123 of the General Laws as appearing in the 2004 Official Edition, is hereby amended by inserting after subsection (e) the following subsection: (f) The right to daily access to fresh air and the outdoors.

Said Section 23 of Chapter 123 as appearing is hereby further amended by striking out the letter (c) and inserting in place thereof the following: (f)

The third paragraph of Section 23 of Chapter 123 is hereby amended by inserting in the first sentence after the letter (c) the wording: and (f).

The third paragraph of Section 23 of Chapter 123 is hereby amended by inserting after the first sentence the following sentence:

The signing of a three-day notice shall not constitute a basis for suspending the rights set forth in clause (f).

The third paragraph of Section 23 of Chapter 123 is hereby amended by inserting in sentence two after the word “suspension” the words: of any right.
