legislation to authorize the town of Middleborough to
convey town-owned conservation land in exchange for other
land to be used as conservation and recreation land.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, the town of Middleborough may convey the 2 parcels of town-owned conservation property described in section 2, currently not in use, to Carl Tucci for use as an access road. In exchange for this conveyance, the town of Middleborough will acquire, hold and use the land described in section 3 as conservation or public recreation land and transfer the care, management, custody and control of this property to the board of selectmen and the conservation commission for the purpose. The board of selectmen may make this exchange on such terms and conditions as it considers appropriate.
SECTION 2. The land which may be conveyed by the town of Middleborough, as authorized in section 1, is that town-owned property located in Middleborough shown as lot 2175 and lot 3665 on assessors map 110, located on or near Wareham street and being a portion of the real estate described in a deed of William A. Byrne and Jean M. Byrne and recorded in the Plymouth county registry of deeds at book 10517, page 090. The town of Middleborough may transfer the care, management, custody and control of said lot 2175 and lot 3665 to the board of selectmen and conservation commission for the purpose of exchanging these lots for the land described in section 3.
SECTION 3. The land to be acquired by the town of Middleborough, as authorized in section 1, is located on and near Plymouth street, as shown as lot 1746 on assessors map 31 and is presently in the process of being acquired by Carl Tucci.
SECTION 4. This act shall take effect upon its passage.
