AN ACT authorizing the town of Middleborough to use a portion of town-owned land for purposes other than water supply protection and storage

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding any general or special law to the contrary, the town of Middleborough may change the use of the property described in section 2, from its current use as public water supply and aquifer protection and public water supply storage, for use as athletic playing fields, the site of a future school and for gravel mining and a parking lot. 

SECTION 2.  The land for which the use is changed in section 1 is that town-owned property located on or near Fuller street and on or near Plympton street in Middleborough bounded and described in a deed of Annamarie Barnhart, dated September 30, 2002, and recorded in the Plymouth county registry of deeds at book 23007, page 244, and an order of taking dated October 7, 2002, and recorded in said registry at book 23193, page 343 and property bounded and described in a deed of Jonathan D. White, Trustee of Preserve Realty Trust, dated October 1, 2002, and recorded in said registry at book 23007, page 258.

Section 3.  This act shall take effect upon its passage.
