Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 40 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by inserting, after section 33, the following new section:-
Section 33A. Upon acceptance of this section by a city or town, with the approval of the local governing body, a municipality may adopt provisions to prohibit the posting of unauthorized signs, bills or posters on any municipal traffic control device, utility pole, lamp post or other municipally-owned buildings, structures or trees. Exceptions may be provided to allow for the temporary posting of certain signs, bills or posters deemed to be acceptable, including, but not limited to, those advertising yard sales or lost pets, provided the signs, bills or posters are removed within a reasonable time frame, as determined by the municipality. When enforcing the provisions of this section, a city or town may assess reasonable fines against any individual or company found to be in violation of this section.
