RESOLVE relative to banning lead in toys and jewelry

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. There shall be a special commission established for the purpose of making an investigation and study relative to the ban of lead in children’s toys and jewelry.  Said commission shall consist of 3 members of the senate, 3 members of the house of representatives, the commissioner of public health or his designee and 4 members to be appointed by the governor.  Said investigation and study shall include, but not be limited to the extent and effect of such lead poisonings as a result of exposure to child toys and jewelry, a review of past scientific studies, state and federal laws and regulations, a proposal to conduct store surveys to determine the extent at which these products are readily available on the market, and a drafting of new legislation and regulations, including penalties for sale or distribution of these materials in Massachusetts. 

SECTION 2.  The commission shall file a report of the result of its investigation and study, and its recommendations, if any, together with drafts of legislation and regulations necessary to carry its recommendations into effect with the clerks of the house of representatives and senate, and the joint committee on public health, on or before December 31, 2007.
