Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 1 of Chapter 94 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out the definitions of "Article of food" and "Bakery"
SECTION 2. Said Section 1 of Chapter 94, as so appearing, is hereby further amended by striking out the definition of "Cold storage", and inserting in place thereof the following definition:- "Cold storage," the storage of food at or below a temperature of 41 degrees Fahrenheit for a period of 30 days or more.
SECTION 3. Said section 1 of Chapter 94 is hereby further amended by striking out the definition of "Cold storage or refrigerating warehouse" and inserting in place thereof the following definition:- "Cold storage or refrigerating warehouse," an establishment employing refrigerating machinery where food is stored for 30 days or more at or below a temperature of 41 degrees Fahrenheit.
SECTION 4. Sections 2,3,4,5,6, 7,8, 9, 9A, 9B, 9C, 9D, 9E, 9F, 9G, 9H, 9I, 9J, 9K, 9L, 9M, 10 66, 66A, 67, 68, 69, 70, 71, 72, 73, 73A and 305E of Chapter 94 are hereby repealed.
SECTION 5. Section 305C of Chapter 94, as appearing in the 2002 Official Edition, is hereby amended by inserting in line 1, after the word "department" the words:- of public health, hereinafter called the department.
SECTION 6. Said section 305C of Chapter 94, as so appearing, is hereby further amended and by inserting after the word "warehouse", in line 5, the following words:- or cold storage or refrigerating warehouse.
SECTION 7. Said section 305C of Chapter 94, as so appearing, is hereby further amended and by striking out, in line 9, the words "sixty-six
SECTION 8. Said section 305C of Chapter 94, as so appearing, is hereby further amended by inserting after the "commissioner" in line 38, the following words:- the department of public health.
