AN ACT mandating fire life safety

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. An Act Mandating Fire Life Safety

            The following Residential Buildings shall be equipped with an interior finish, Massachusetts manufactured, fire resistant, in tumescent, refractory, paint to protect residents.  All owners of residential building required to equip their buildings with Fire Resistant paint, must do so and come into compliance within one year from the passage of this bill.

Definitions for the purpose of this mandate:

(1)   Fire Resistant Paint shall mean in tumescent, refractive, thin film, durable, flexible, non toxic paint that delays flashover, reduces smoke, and reduces the production of toxic materials entering the immediate and general environment as a result of a fire.

(2)   Manufacturers of the Paint shall be Massachusetts manufacturers and be required to show evidence of ISO 9000-9001 standards of quality certification.

(3)   For purposes of this statute the paint used shall be approved by the Toxic Use Reduction Institute of the University of Massachusetts.

(4)   For purposes of this statute Residential Buildings shall mean all student housing, nursing homes, assisted living facilities, and shelters located within the Commonwealth of Massachusetts.
