Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding the provisions of section 3B of chapter 7 of the General Laws, or of any other general or special law, rule or regulation to the contrary, the inspection fee for residential elevators and wheelchair lifts that are determined to be medically necessary shall be $100 per inspection and $100 per overtime inspection. For the purposes of this act, the words “overtime inspection” shall be defined as an inspection taking place after 5 p.m. or during weekend hours.
Notwithstanding the provisions of the preceding paragraph, the department of public safety shall provide a full waiver of the inspection fee for those individuals who require a residential elevator or a wheelchair lift as a medical necessity and whose annual income does not exceed the maximum allowable federal SSI benefit, or $7,236 a year, whichever is greater.
Subject to appropriation, the Massachusetts Office on Disability and the Massachusetts Rehabilitation Commission shall annually be allocated sufficient funding to assist those individuals with disabilities who require a residential elevator or wheelchair lift as a medical necessity, but whose income exceeds the maximum allowable amount to qualify for the inspection fee waiver.
