AN ACT providing for the elminiation of severance packages to certain employeyees of state, city, or town or other governmental authorites.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 44 of Chapter 62 of the General Laws, as appearing in the 2006 Official Edition, is hereby amended by inserting after paragraph (m) the following paragraph :-

(n) No director, executive, administrator, employee or consultant under contract of any state, city or town, governmental board or authority shall be entitled to a severance package lump sum payment or payments in excess of his or her regular vacation and sick time benefits.

The Administration and Finance Department personnel rule stating state employees shall be entitled to only 20% of their accrued sick and vacation time, in payments when they leave or are retired from state service, shall apply to all employees in all state, city or town, governmental boards and authorities, or as the benefit rule may change by7 the Administration and Finance Department.

SECTION 2. Chapter 32 of the General Laws, as appearing in the 2006 Official Edition, is hereby amended by inserting after Section 105, the following section:-

Section 106.  No person working two governmental positions shall be allowed to leave or retire with benefits accruing from the two positions, for sick time and vacation time, but will have to choose from which Agency the benefits shall be taken. No person shall use sick time and vacation time from one agency while going to work for another agency at the same concurrent time of employment.
