AN ACT relative to retirement benefits for spouses of disabled veterans

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Chapter 32 of the General Laws is hereby amended by inserting after section 95B, as appearing in the 2004 Official Edition, the following section:-

Section 95C.  For the purpose of promoting the public good and in consideration of the meritorious service of disabled veterans, the surviving spouse of a deceased disabled veteran, who had a disability rating of 10 per cent or greater and who was an active member of a system at the time of death, may be credited with the service rendered by the deceased spouse for the purpose of determining a retirement allowance under this chapter.  Eligibility for the creditable service shall be conditioned upon payment into the system for the period of service rendered by the deceased spouse based on the rate of payment made into the system by the surviving spouse during the surviving spouse’s first 2 years of employment.
