AN ACT authorizing the state retirement board to grant certain benefits

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

Whereas, the deferred operation of this act would tend to defeat its purpose, which is to authorize forthwith the payment of certain retirement benefits to Claire Bresnahan, therefore it is hereby declared to be an emergency law necessary for the immediate preservation of the public convenience.

Notwithstanding the provisions of any general or special law or rule to the contrary, and in order to promote the public good, the state retirement board shall pay Claire Bresnahan, the surviving spouse of James P. Bresnahan, a former employee of the Massachusetts Lottery, retirement benefits as of November 11, 1999, equal to benefits which would have been paid to her had said James P. Bresnahan been retired for superannuation as of said date and had elected to receive a pension or retirement allowance under the provisions of option ( c) of subdivision (2) of section 12 of chapter 32 of the General Laws.
