the reinstatement of Linda Schaeffer-Phillips as a member
in service of the state retirement system. Public Service.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, Linda Schaeffer-Phillips shall be eligible to be reinstated as a member in service of the state retirement system as of the effective date of this act, if she pays to the state retirement system an amount equal to the total amount of any state retirement system deductions together with interest thereon, that would have been made between the time of her involuntary separation from the Early Intervention Program of the Division of Family Health Services and the time of her reinstatement, such repayment to be made in 1 sum or in installments as the state board of retirement shall prescribe. Upon such reinstatement, regular deductions shall be made from her regular compensation pursuant to an agreement entered into between the state retirement system and her employer for which her date of entry into service shall be the date of her initial employment by the Commonwealth, January 3, 1978. Upon completion of such repayment, said Susan Schaeffer-Phillips shall be entitled to creditable service for all periods for which deductions were made from her regular compensation and for those years when she has been employed by the private vendor that assumed the duties formerly provided through state agency personnel.
Upon reinstatement as a member in service of the state retirement system, said Susan Schaeffer-Phillips shall be eligible, upon the payment of regular deductions together with interest thereon to establish creditable service with the said system for the period of service during which she previously would have been credited had the Commonwealth continued as direct employer rather than through a vendor.
In no event shall Susan Schaeffer-Phillips be allowed to retire until she has made the repayments required by the first paragraph of this act in full. Any pension allowance, or other retirement benefit provided hereunder shall be exclusive of and in the alternative to any other pension, allowance, or other retirement benefit, including any provided for under general or special law.
