Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding the provisions of chapter 163 of the Acts of 2005 the commissioner of the department of revenue with the approval of the treasurer of the commonwealth is hereby authorized and directed to refund the sum of seven thousand four hundred ninety-six dollars and forty-nine cents of any available funds to Loretta Medalia of Lowell which represents the amount of capital gains and penalties which was incurred by the failure of the department to provide a timely application for refund to her.
