AN ACT requiring accurate pricing of default service

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Subsection (d) of Section 1B of Chapter 164 of the General Laws is hereby amended by replacing the second and third sentence of the subsection with the following:

“The distribution company shall procure such service through competitive bidding; provided, however, that all bids shall include payment options with rates that remain uniform for periods of up to six months. Any department-approved provider of service, including an affiliate of a distribution company, shall be eligible to participate in the competitive bidding process.  Default services rates shall reflect all costs that are both incurred by a distribution company relating to default service and approved by the department for recovery; no costs incurred by a distribution company relating to default service shall be recovered in distribution or other rates.”

SECTION 2.  This act shall take effect upon passage.
