No. 2111) of Steven A. Tolman and Martin J. Walsh for
legislation to require certain safety devices in the
controlling compartment of all railroad locomotives
operated within the Commonwealth. Transportation.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter One Hundred and Sixty of the General laws is hereby amended by inserting after Section 176A the following new section:
Section 176B. Every railroad corporation and
railway company shall equip the controlling cab compartment of every
locomotive, engine, and control car with a safety device generally known as an
alerter, a deadman control,
or any similar feature which assures that the locomotive engineer is alert or
not physically incapacitated. Such safety devices
provide visual or audible warning alarms to the locomotive engineer and will
apply the locomotive and train brakes in the event the locomotive engineer is
incapacitated. The department shall promulgate rules and
regulations necessary for the implementation and enforcement of this
section.
