SENATE, No. 2473

SECTION 1. Section 3 of chapter 22 of the General Laws, as appearing in the 2006 Official Edition, is hereby amended by striking out the second sentence.

SECTION 2.  Section 4A of said chapter 22, as so appearing, is hereby amended by striking out the first and second sentences.

SECTION 3. Said section 4A of said chapter 22, as so appearing, is hereby amended by striking out, in line 9, the words “division of inspection” and inserting in place thereof the following words:- department of public safety.

SECTION 4.  Said chapter 22, as so appearing, is hereby amended by striking out section 5.

SECTION 5.  Section 6 of said chapter 22, as so appearing, is hereby amended by striking out the third sentence.

SECTION 6.  Said section 6 of said chapter 22, as so appearing, is hereby further amended by striking out, in line 8, the words “division of inspection” and inserting in place thereof the following words:- department of public safety.

SECTION 7. Section 10 of said chapter 22, as so appearing, is hereby amended by striking out, in lines 2 and 3, the words “chief of inspections, or a boiler inspector of the division of inspection designated by the commissioner” and inserting in place thereof the following words:- commissioner or his designee, or a boiler inspector designated by the commissioner.

SECTION 8.  Section 11 of said chapter 22, as so appearing, is hereby amended by striking out, in lines 4 to 7, inclusive, the words “chief of inspections in said department, with power to designate from time to time an inspector in said department to act temporarily as a member of such board,” and inserting in place thereof the following words:-  commissioner or his designee.

SECTION 9. Section 50 of chapter 143 of the General Laws, as so appearing, is hereby amended by striking out, in line 2, the words “, the chief of inspections of the department”.

SECTION 10. Section 93 of said chapter 143, as so appearing, is hereby amended by striking out, in lines 7 and 8, the words “chief of inspections of the division of inspection of the department” and inserting in place thereof the following word:-  commissioner.

SECTION 11. Said section 93 of said chapter 143, as so appearing, is hereby further amended by striking out, in line 44, the words “chief of inspections” and inserting in place thereof the following word:-  commissioner.

SECTION 12. Section 94 of said chapter 143, as so appearing, is hereby amended by striking out, in line 52, the words “chief of inspections” and inserting in place thereof the following word:-  commissioner.

SECTION 13. Section 1 of chapter 146 of the General Laws, as so appearing, is hereby amended by striking out the definition of “Chief”.

SECTION 14. Said section 1 of said chapter 146, as so appearing, is hereby further amended by striking out the definition of “Division.”

SECTION 15. Said section 1 of said chapter 146, as so appearing, is hereby further amended by striking out, in lines 17 and 18, the words “of the division of inspection”.

SECTION 16. Section 13 of said chapter 146, as so appearing, is hereby amended by striking out, in line 2, the words “division, under the supervision of the chief” and inserting in place thereof the following words:- department, under the supervision of the  commissioner or his designee.

SECTION 17. Said section 13 of said chapter 146, as so appearing, is hereby further amended by striking out, in line 7, the words “chief of inspections” and inserting in place thereof the following words:- commissioner or his designee.

SECTION 18.  Section 17 of said chapter 146, as so appearing, is hereby amended by striking out, in line 2, the word “chief” and inserting in place thereof the following word:- commissioner.

SECTION 19.  Section 18 of said chapter 146, as so appearing, is hereby amended by striking out, in lines 1 and 3, the word “chief” and inserting in place thereof, in each instance, the following word:- commissioner.

SECTION 20. Section 19 of said chapter 146, as so appearing, is hereby amended by striking out, in line 2, the word “chief” and inserting in place thereof the following words:- commissioner or his designee.

SECTION 21.  Section 21 of said chapter 146, as so appearing, is hereby amended by striking out, in lines 8 and 12,  the word “division” and inserting in place thereof, in each instance, the following word:- department.

SECTION 22.  Section 22 of said chapter 146, as so appearing, is hereby amended by striking out, in line 1, the word “division” and inserting in place thereof the following  word:- department.

SECTION 23.  Section 23 of said chapter 146, as so appearing, is hereby amended by striking out, in line 1, the word “division” and inserting in place thereof the following word:- department.

SECTION 24. Section 24 of said chapter 146, as so appearing, is hereby amended by striking out, in lines 1 and 4, the word “division” and inserting in place thereof, in each instance, the following word:- department.

SECTION 25.  Section 26 of said chapter 146, as so appearing, is hereby amended by striking out, in line 3, the word “chief” and inserting in place thereof the following word:- commissioner.

SECTION 26.  Section 27 of said chapter 146, as so appearing, is hereby amended by striking out, in line 1, the word “division” and inserting in place thereof the following word:- department.

SECTION 27.  Section 29 of said chapter 146, as so appearing, is hereby amended by striking out, in line 2, the word “division” and inserting in place thereof the following word:- department.

SECTION 28.  Section 30 of said chapter 146, as so appearing, is hereby amended by striking out, in line 5, the word “division” and inserting in place thereof the following word:- department.

SECTION 29.  Section 31 of said chapter 146, as so appearing, is hereby amended by striking out, in line 4, the word “division” and inserting in place thereof the following word:- department.

SECTION 30.  Section 32 of said chapter 146, as so appearing, is hereby amended by striking out, in line 2, the word “division” and inserting in place thereof the following word:- department.

SECTION 31.  Section 34 of said chapter 146, as so appearing, is hereby amended by striking out, in lines 7 and 8 and in line 31, the word “division” and inserting in place thereof, in each instance, the following word:- department.

SECTION 32.  Section 38 of said chapter 146, as so appearing, is hereby amended by striking out, in line 4, the word “division” and inserting in place thereof the following word:- department.

SECTION 33.  Section 44 of said chapter 146 of the General Laws, as so appearing, is hereby amended by striking out, in line 2, the word “division” and inserting in place thereof the following word:- department.

SECTION 34.  Section 45A of said chapter 146, as so appearing, is hereby amended by striking out, in lines 10, 17, 24, 29 and 30, the word “division” and inserting in place thereof, in each instance, the following word:- department.

SECTION 35.  Said section 45A of said chapter 146, as so appearing, is hereby further amended by striking out, in line 18, the word “chief” and inserting in place thereof the following word:- commissioner.

SECTION 36. Section 49 of said chapter 146, as so appearing, is hereby amended by striking out, in line 44, the words “, in consultation with the chief inspector,”.

SECTION 37.    Section 50A of said chapter 146, as so appearing, is hereby amended by striking out, in line 47, the words “chief of inspections” and inserting in place thereof the following words:-  the commissioner.

SECTION 38.  Section 56  of said chapter 146, as so appearing, is hereby amended by striking out, in line 1, the words “chief and inspectors of the division ” and inserting in place thereof the following words:- commissioner or his designee and inspectors of the department.

SECTION 39.  Section 62  of said chapter 146, as so appearing, is hereby amended by striking out, in lines 29 and 32, the word “division” and inserting in place thereof, in each instance, the following word:- department.

SECTION 40.  Said section 62 of said chapter 146, as so appearing, is hereby further amended by striking out, in line 32, the word “chief” and inserting in place thereof the following word:- commissioner.

SECTION 41.  Section 64 of said chapter 146, as so appearing, is hereby amended by striking out, in lines 5 and 6, the words “, in consultation with the chief,”.

SECTION 42.  Said section 64 of said chapter 146, as so appearing, is hereby further amended by striking out, in line 10,  the word “chief” and inserting in place thereof the following word:- commissioner.

SECTION 43.  Said section 64 of said chapter 146, as so appearing, is hereby further amended by striking out, in line 24, the words “chief, if such chief is a qualified examiner,” and inserting in place thereof the following word:- commissioner.

SECTION 44.  Said section 64 of said chapter 146, as so appearing, is hereby further amended by striking out, in line 29,  the word “division” and inserting in place thereof the following word:- department.

SECTION 45.  Section 66 of said chapter 146, as so appearing, is hereby amended by striking out, in line 4, the words “chief, who shall appoint three inspectors of the division” and inserting in place thereof the following words:- commissioner, who shall appoint three inspectors of the department.

SECTION 46.  Section 67 of said chapter 146, as so appearing, is hereby amended by striking out, in line 23, the word “division” and inserting in place thereof the following word:- department.

SECTION 47.  Said section 67 of said chapter 146, as so appearing, is hereby further amended by striking out, in lines 25 and 26 the words “chief or an inspector of the division” and inserting in place thereof the following words:- commissioner or an inspector of the department.

SECTION 48.  Said chapter 146, as so appearing, is hereby further amended by striking out section 67A and inserting in place thereof the following section:- 
Section 67A.  The commissioner or his designee, the supervising inspector of the department or an inspector of the department shall act as an examiner for the certification of oil burner technicians. The commissioner shall cause examinations to be held in such cities and at such times as he may deem necessary.

SECTION 49.  Section 70 of said chapter 146, as so appearing, is hereby amended by striking out, in line 18, the words “chief of inspections” and inserting in place thereof the following words:-  commissioner or his designee.

SECTION 50.  Said section 70 of said chapter 146, as so appearing, is hereby further amended by striking out, in lines 21 and 22,  the word “division” and inserting in place thereof the following word:- department.

SECTION 51.  Section 71 of said chapter 146, as so appearing, is hereby amended by striking out, in lines 27 and 30, the word “division” and inserting in place thereof, in each instance, the following word:- department.

SECTION 52.  Section 72 of said chapter 146, as so appearing, is hereby amended by striking out, in lines 1 and 4, the word “division” and inserting in place thereof, in each instance, the following word:- department.

SECTION 53.  Section 73 of said chapter 146, as so appearing, is hereby amended by striking out, in line 7, the words “chief of inspections” and inserting in place thereof the following words:-  commissioner or his designee.

SECTION 54.  Said chapter 146, as so appearing, is hereby further amended by striking out section 77 and inserting in place thereof the following section:-
Section 77. The inspectors of the department shall make reports of all inspections and shall make such recommendations to the commissioner as they may deem expedient. Every insurance company shall forward to the commissioner, within 14 days after each inspection, reports of all boilers inspected by it. Such reports shall be made on blanks approved by the commissioner and shall contain all orders made by the company regarding such boilers. Every insurance company shall report immediately to the commissioner the name of the owner or user and the location of every boiler required by section 70 to be inspected, upon which they have cancelled or refused insurance, giving the reasons therefor.

SECTION 55.  Section 78 of said chapter 146, as so appearing, is hereby amended by striking out, in lines 7 and 8, and in lines 12, 14 and 20, the word “division” and inserting in place thereof, in each instance,  the following word:- department.

SECTION 56.  Section 10G of chapter 148 of the General Laws, as so appearing, is hereby amended by striking out, in line 8, the words “chief of inspections of the department” and inserting in place thereof the following word:- commissioner.
