Be it enacted by the Senate and House of
Representatives in General Court assembled,
Chapter 258 of the Acts of 1980, as amended by chapter 135 of the acts of 1983, by chapter 463 of the acts of 1991 and by chapter 5 of the Acts of 2000, is hereby further amended as follows: By striking chapter 135 of the acts of 1983 in total and by striking the first sentence of Chapter 258 of the Acts of 1980 and inserting in place thereof the following: - The number of licenses for the sale of all alcoholic beverages under section 12 of chapter 138 of the General Laws shall be calculated pursuant to section 17 of said chapter 138, provided that the licensing commission of the city of Somerville is hereby authorized and directed to assign ten licenses for the sale of all alcoholic beverages to be drunk on the premises to the area presently known and bounded as “Assembly Square Mixed Use District,” as established under the Somerville Zoning Ordinance, for the purpose of promoting revitalization and economic vitality. Said ten licenses shall be allocated from among the licenses authorized to be granted under the provisions of section 17 of said chapter 138 and they shall not increase in any way the number of such licenses now or hereafter available in said city. Licenses granted under the provisions of this act shall be subject to the notice and hearing requirements of the General Court and all applicable ordinances of the city. The licenses assigned to the “Assembly Square Mixed Use District” may not be the subject of any sale or transfer by the licensee, upon the licensee failing to renew or otherwise continue operating under the license, the license shall revert to the licensing commission and may only be reissued to otherwise qualified applicants doing business within the “Assembly Square Mixed Use District.” The administrative fee charged by the City for such licenses shall be the same amount as the administrative fee charged by the City for existing licenses issued for the respective category for such licenses.
