Whereas, The deferred operation of this act would tend to defeat its purpose, which is forthwith provide certain retirement survivor benefits, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
Be it enacted by the Senate and House of
Representatives in General Court assembled,
SECTION 1. Notwithstanding any general or special law, rule or regulation to the contrary, the State Board of Retirement shall grant creditable service to Richard Greco, a deceased former assistant district attorney in the middle district, in an amount as set forth herein. Said service shall be credited upon payment into the State Employees’ Retirement System (by his widow, Maria Ottaviano), of an amount calculated by the Board equal to the amount of deductions that Richard Greco would have contributed based on his last annual rate of regular compensation, had he been in service for the period October 18, 2007 through January 19, 2008, plus interest, that would have accrued if he had been making retirement contributions during that period.
SECTION 2. Notwithstanding any general or special law, rule or regulation to the contrary, upon contribution of the above amount, the State Board of Retirement shall re-calculate the retirement survivor benefit payable to Maria Ottaviano pursuant to section 12 of chapter 32 of the General Laws as if Richard Greco had been in service and to include the additional creditable service described in Section 1 of this Act. Said re-calculated benefit shall be retroactive to January 19, 2008.
