The following proposal (introduced into the General Court by initiative petition of Harold Hestnes and others) (see Senate, No. 4 of 2005), having received, in joint session, the affirmative votes of not less than one-fourth of all members elected [see House, No. 4444, amended of 2004], has been referred, in accordance with Article XLVIII of the Amendments to the Constitution, to the present General Court.

PROPOSAL FOR AN INITIATIVE AMENDMENT TO THE CONSTITUION RELATIVE TO THE PROVISION OF HEALTH INSURANCE

A majority of all the members elected to the Senate and of Representatives, in joint session, hereby declares it to be expedient to alter the Constitution by the adoption of the following Article of Amendment, to the end that it may become a part of the Constitution [if similarly agreed to in a joint session of General Court and approved by the people at the state next following]:

ARTICLE OF AMENDMENT.

Section 1: The People of the Commonwealth of Massachusetts hereby declare it necessary and expedient to alter the Constitution by the adoption of the following Article of Amendment:

Upon ratification of this amendment and thereafter, it shall be the obligation and duty of the Legislature and executive officials, on behalf of the Commonwealth, to enact and implement such laws, subject to approval by the voters at a statewide election, as will ensure that no Massachusetts resident lacks comprehensive, affordable and equitably financed health insurance coverage for all medically necessary preventive, acute and chronic health care and mental health care services, prescription drugs and devices.
