Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1.
The commissioner of the division of capital asset management and maintenance, in consultation with the metropolitan district commission, is hereby authorized, notwithstanding the provisions of sections 40E through 40J, inclusive, of Chapter 7 of the General Laws or any other general or special law to the contrary, to convey to the city of Quincy a certain parcel of land owned by the commonwealth as specifically described herein and located in the city of Quincy for nominal consideration of one dollar and to be used by said city for cemetery purposes. Said parcel is located off Ricciuti Drive in said city and is shown as plots 3, 4, 5, 6, 7, 8, and 10 on the Assessors’ Plan 4126B as recorded with the Norfolk county registry of deeds. The above described parcel of land contains an area of 39.8+/- (thirty-nine and eight/tenths) acres as shown on said plan.
SECTION 2. The transfer pursuant to section 1 shall be made only if the mayor and city council, acting for and on behalf of said city notwithstanding any general or specific law, convey by fee simple deed to the commonwealth, under the jurisdiction of the Metropolitan District Commission, for nominal consideration of one dollar, for the purpose of protection of endangered species habitat protection, a certain parcel of land situated in said city and currently under care and control of the Quincy Cemetery Department, having been acquired by said city for cemetery purposes. Said parcel shall consist of a portion of land located within the Pine Hill Cemetery on Willard Street in said city. Said parcel shall be divided from the existing property of the Pine Hill Cemetery and consist of the remaining undeveloped acreage of the Pine Hill Cemetery or approximately 39.8 +/- (thirty-nine and eight/tenths) acres, whichever is larger. Said land to be transferred must be contiguous with the Metropolitan District Commission’s portion of the Blue Hills Reservation in total.
SECTION 3. In the event that the parcel of land or any portion thereof, described in section one of this act, ceases to be used at any time for the purposes described in said section, said parcel or any such portion thereof, together with any improvements thereon shall revert to the commonwealth under the care and control of the metropolitan district commission. Any further disposition of said parcel or any such portion thereof shall be subject to the provisions of sections 40E through 40J, inclusive, of chapter 7 of the General Laws and must have the prior approval of the general court. In the event that such land or any such portion thereof shall revert to the commonwealth an equal portion of the land described in section two of this act shall revert back to the care and control of the city of Quincy and any further disposition of such land or any portion thereof shall be subject to the provisions of Chapter 30B of the General Laws.
SECTION 4. Land designated under chapter 183 of the acts and resolves of 2002 shall be exempt from the provisions of this act.
SECTION 5. This act shall take effect upon its passage.
