AN ACT RELATIVE TO HOSPITAL INFECTION DISCLOSURES

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.

Chapter 111 of the General Laws, as appearing in the 2002 official edition, is amended after section 218 by adding the following new sections:-

Section 219. The department shall promulgate rules and regulations necessary to collect from every licensed hospital in the Commonwealth information on the number and frequency of infections caused by the following procedures: Surgical site infections; Ventilator-associated pneumonia; Central line-related bloodstream infections; Urinary tract infections; and any other clinical procedures as determined by the department.  Said infections reported are those caused from a localized or systemic condition that results from adverse reaction to the presence of an infectious agent(s) or its toxin(s) and that was not present or incubating at the time of admission to the hospital.

The department shall collect said information on a quarterly basis.   The department shall make said reports available to the public within one month of receiving said report in compliance with chapter 66 of the General Laws.

The Governor shall establish an member advisory committee composed of the Commissioner of Department of Public Health, a representative from the Massachusetts Hospital Association, a representative from the Massachusetts Nurses Association, a representative from the Massachusetts Medical Society, a representative from the Massachusetts Hospital Association, a person employed as staff of a direct care nursing facility, a licensed physician, a licensed epidemiologists, a scientific researcher who specializes in infections, and an representative from a patients consumer group.  The committee is responsible for reviewing the department’s methodology of collecting, analyzing, and disclosing the information; which shall include but not limited to information collection, formatting, release and dissemination, and the quality and accuracy of hospital information collected and analyzed.   The committee shall meet not less than four times a year.

The department and the committee shall annually submit to the Legislature a report summarizing the data collected and make recommendations to the Legislature of any legislative changes that maybe needed. 

Any licensed hospital in the Commonwealth, which does not comply with section and the rules and regulation set forth by the department be have its license revoked or suspended by said department, be fined up to $1,000 per day per violation, or both.
