SECTION 1. Section 118 of chapter 94 of the General Laws, as appearing
in the 2004 Official Edition, is hereby amended by inserting after the definition
of "Department" the following new definition: -
"Force Feeding", any method of feeding poultry that causes the poultry
to ingest an excessive quantity of food, or more food than a typical bird of
the same species would consume voluntarily while foraging, for the purpose of
enlarging the bird's liver to beyond normal size. Force feeding methods include,
but are not limited to, delivering feed through a tube or other device inserted
into the poultry's esophagus.
SECTION 2. Subsection (a) of Section 127 of said chapter 94 is hereby
amended by inserting after clause (3) the following new clause: -
(4) force feed poultry, or hire another person to do so.
SECTION 3. Section 130 of said chapter 94 is hereby amended by inserting
after the word "inclusive", in line 3, the following words: -
except, operations in violation of clause (4) of subsection (a) of section 127.
SECTION 4. Section 129 of said chapter 94 is hereby f amended by inserting
after the first paragraph the following paragraph: -
Any violation of clause (4) of subsection (a) of section 127 shall be punished
as a crime as defined by Section 77 of Chapter 272. A separate violation of
said clauses, subject to a separate fine, occurs each time an individual bird
is force fed.
