The Chair (Mr. Timilty), members, guests and staff then recited the pledge of allegiance to the flag.

Report of a Committee.

By Mr. McGee, for the committee on Transportation, on Senate, No. 1736, an Order relative to authorizing the joint committee on Transportation to make an investigation and study of a certain current Senate document relative to transportation matters (Senate, No. 2138);
Referred, under Joint Rule 29, to the committees on Rules of the two branches, acting concurrently.

Matter Taken Out of the Orders of the Day.

There being no objection the following matter was taken out of the Orders of the Day and considered, as follows:
The Senate Bill authorizing the town of Plymouth to establish an other post-employment benefits fund (Senate, No. 2030),-- was read a second time, ordered to a third reading, read a third time and passed to be engrossed.
Sent to the House for concurrence.

Report of a Committee.

By Mr. Brewer, for the committee on Ways and Means, that the Senate Bill relative to the emergency service response of public utility companies (Senate, No. 2136),-- ought to pass, with an amendment substituting a new draft with the same title (Senate, No. 2140).

Order Adopted.

Mr. Brewer offered the following order, to wit:

Ordered, That notwithstanding Senate Rule 7 or any other rule to the contrary, Senate Bill relative to the emergency response by public utility companies (Senate, No. 2136), with the pending Ways and Means new draft (Senate, No., 2140) shall be placed in the Orders of the Day for a second reading on Thursday, February 16, 2012.

All amendments shall be filed electronically in the office of the Clerk of the Senate by 5:00 P.M., on Wednesday, February 15, 2012. All such amendments shall be second-reading amendments to the Ways and Means new draft (Senate, No. 2140) but further amendments in the third degree to such amendments shall be in order. The Clerk shall further specify the procedure and format for filing all amendments, consistent with this order.
After the bill as amended is ordered to a third reading, it shall immediately be read a third time and the question shall then immediately be on passing it to be engrossed, and no amendments shall be in order at the third reading of the bill unless recommended by the committee on Bills in the Third Reading.
Under the rules, referred to the committee on Ethics and Rules.
Subsequently, Mr. Berry, for the said committee, reported, recommending that the order ought to be adopted.
The rules were suspended, on motion of Mr. Richard T. Moore, and the order was considered forthwith and adopted.
The bill (Senate, No. 2136) was placed in the Orders of the Day for Thursday, February 16, 2012, for a second reading with the Ways and Means new draft (Senate, No. 2140) pending.

Reports of Committees.

By Mr. Brewer, for the committee on Ways and Means, that the Senate Bill relative to real estate tax abatements (Senate, No. 2027),-- ought to pass.
Referred, under Senate Rule 26, to the committee on Ethics and Rules.
Subsequently, Mr. Berry, for the said committee on Ethics and Rules, reported that the matter be placed in the Orders of the Day for Thursday, February 16th.

Mr. Berry, for the committee on Ethics and Rules, reported that the following matter be placed in the Orders of the Day:
The Senate Bill relative to medical emergency response plans for schools (Senate, No, 2110) (the committee on Health Care Financing having recommended that the bill be amended by substituting a new draft with the same title, Senate, No, 2132).
There being no objection, the rules were suspended, on motion of Mr. Richard T. Moore, and the bill was read a second time and was amended, as previously recommended by the committee on Health Care Financing, substituting a new draft entitled “An Act relative to medical emergency response plans for schools” (Senate, No. 2132).
The bill (Senate, No. 2132) was then ordered to a third reading.

By Mr. Berry, for the committees on Rules of the two branches, acting concurrently, that Joint Rule 12 be suspended on the Senate petition of Michael R. Knapik and Donald F. Humason, Jr. for legislation to establish the 104th fighter wing fire department.
The rules were suspended, on motion of Mr. Richard T. Moore, and the report was considered forthwith. Joint Rule 12 was suspended; and the petition (accompanied by bill) was referred to the committee on Public Safety and Homeland Security.
Sent to the House for concurrence.
